The Suicide in light of the Hart–Devlin debate

Throughout the years, suicidal acts were undoubtedly seen as a subject of controversy, both from the psychological and legal perspective. This paper aims to examine said matter, focusing on the law and morality aspect of the decriminalisation of suicide. The author analyses suicide by utilizing the historical, sociological, and philosophical perspective, drawing specifically on the legacy of the Hart–Devlin debate. Neither Hart’s, nor Devlin’s viewpoints present a satisfactory conclusion, the cause of it being the conflict between the two fundamental values: the right to life and freedom. In spite of the minor significance of suicide discourse nowadays, the conclusions stemming from its analysis may lead to further discoveries on the ground of philosophy of law.
