Abstract

The European Court of Human Rights (ECtHR) plays a pivotal role in the enforcement of fundamental rights and the development of human rights protection standards within the European legal framework. Through its jurisprudence, the ECtHR contributes significantly to shaping the scope and content of these standards, particularly in relation to the Charter of Fundamental Rights of the European Union. This article aims to examine the Court’s function as a guarantor of judicial human rights protection at the international level. The analysis encompasses both the legal foundations of the Court’s operation and the mechanisms for implementing and enforcing its judgments concerning fundamental rights. The article offers a review and critical discussion of selected landmark cases that warrant in-depth consideration. The cases discussed address, among other issues, the right to a fair trial, freedom of expression, and the challenges arising in the context of digital realities.
