Abstrakt

Celem artykułu jest analiza Memorandum w sprawie gwarancji bezpieczeństwa w związku z przystąpieniem Ukrainy do Układu o nierozprzestrzenianiu broni jądrowej zawartego w 1994 r. między Ukrainą, Rosją, USA i Wielką Brytanią, nazywanego również Memorandum Budapesztańskim. Miało ono zagwarantować bezpieczeństwo Ukrainie w zamian za przekazanie Rosji znajdującej się na jej terytorium broni jądrowej. Po agresji Rosji na Ukrainę w 2014 r. memorandum stało się jednym z najczęściej przywoływanych instrumentów, które swoimi działaniami miała naruszyć Rosja. Celem artykułu jest odpowiedzenie na pytanie, czy memorandum jest wiążącym aktem prawnym czy może tylko porozumieniem o charakterze politycznym, jak również wskazanie na konsekwencje wyniku takiego badania.

    Agata Kleczkowska – adiunkt w Zakładzie Prawa Międzynarodowego Publicznego w Instytucie Nauk Prawnych PAN. Jej zainteresowania naukowe koncentrują się wokół zagadnień groźby i użycia siły, zagrożeń hybrydowych, retorsji, państwowości i uznania międzynarodowego. Kierowała lub uczestniczyła w projektach badawczych dotyczących podmiotów nieuznawanych w prawie międzynarodowym, regulacji użycia siły w międzynarodowym prawie zwyczajowym oraz statusu zbrojnych aktorów niepaństwowych. Od maja 2020 r. realizuje projekt badawczy w konkursie OPUS NCN dotyczący retorsji w prawie międzynarodowym. Autorka monografii naukowej Użycie siły zbrojnej między państwami w świetle międzynarodowego prawa zwyczajowego (Wydawnictwo Naukowe Scholar 2018).
