CALL FOR PAPERS: "Limits of State Intervention. State Functioning and the Protection of Individual Rights under Emergency Regimes"
Accordingly, the forthcoming thematic volume will be devoted to the issue of the limits of state intervention: state functioning and the protection of individual rights under emergency regimes. The publication aims to provide an interdisciplinary analysis of the legal, political, and social mechanisms that shape the operation of the state in times of crisis, with particular emphasis on institutional safeguards designed to protect individual rights and freedoms.
Suggested Areas of Inquiry
- Administrative Authority in States of Emergency – the limits of administrative discretion in issuing decisions, orders, and prohibitions.
- Special Powers of Law Enforcement Agencies and Regulatory Inspectorates – administrative coercive measures in relation to personal liberty and the inviolability of the home.
- Assumption of Control over Local Government Administration – the centralization of governance and its implications for the principle of subsidiarity.
- Administrative Decisions and Local Legal Acts during Periods of Crisis – the stability, transparency, and accessibility of administrative procedures for citizens.
- State Liability for Compensation – the principles and limits governing compensation for pecuniary losses lawfully caused by acts of public authorities.
- Interference with Property Rights and the Freedom to Conduct Business Activities – compulsory requisitions, expropriation measures, and government-imposed market restrictions and prohibitions.
- The Impact of Emergency Regimes on Contractual Relations – the application of the rebus sic stantibus doctrine and force majeure clauses in civil-law contracts.
- Protection of Individual Personal Rights – the limits of privacy, personal data protection, and image rights in the context of mass surveillance or emergency response operations.
- The Legality and Procedures for Declaring Emergency Regimes – an assessment of constitutional mechanisms in both legal theory and political-institutional practice.
- Limits and Mechanisms of the Reallocation of Public Power – the strengthening of executive authority at the expense of legislative institutions, including the use of decree powers with the force of law.
- The Non-Derogable Core of Rights and Freedoms – constitutional and international limits on the suspension or restriction of fundamental human rights.
